Sales After the Show

Sandra is director of River Way Gallery and staged an exhibition of ceramicist Priya Kaur’s work. During the exhibition the gallery was charging a consignment fee of 10% for works sold. Two weeks after the end of the show, when unsold works had been returned to Priya, a supporter of the gallery who saw Priya’s work contacted Sandra, wishing to purchase one of Priya’s works. Can Sandra charge the 10% consignment fee now that the show is over?

The terms of the sale period should be clearly stated in the written agreement. If there is no process in the agreement for the sale period to extend beyond the show and an extension is not undertaken, Sandra cannot charge a consignment fee on the sale.
